Judgment handed down in a Court of Appeal (Civil Division) case in which three members of QEB appeared

Court of Appeal judgment in the long-running financial remedies proceedings of Kanabar v Kanabar [2026] EWCA Civ 582 was published last week following the appeal hearing in April.
Duncan Brooks KC appeared for the appellant, with William Tyzack, leading Sophie Cullis, appearing as Advocates to the Court appointed by the Attorney General.
The appeal decision marked an important point in family law, addressing the consequences where a party dies while pursuing an appeal against a financial remedy order made in matrimonial proceedings.
It confirmed that such an appeal cannot simply continue in the absence of a legally recognised individual.
In this case, the husband had died without a will, with no representative in a position to obtain the legal authority necessary to continue the appeal on behalf of his estate.
