Lewis Marks QC led Rosemary Budden for the wife on her financial remedy application. The husband was domiciled in the USA and during the marriage had established a business facilitating institutional investors to fund and profit from civil litigation. This business was run through a Guernsey company in which both parties had been shareholders and these shares formed substantial part of the assets. The standard of living had been very high with a family spend of £800,000 pa. This is the first reported decision on “stock-piling” periodical payments, in excess of need, for a defined period to build the wife’s assets and facilitate a clean break in the future.
