Oliver Wise (who led Paul Mitchell) represented the defendant solicitors in what is the most high-profile negligence case, involving both matrimonial solicitors and a QC, to be heard in the High Court. The case involved an allegedly negligent settlement, negotiated at the time the landmark case of White v White was under consideration by the House of Lords; and, following the House of Lords decision, an allegedly negligent failure to advise that the client withdraw from the agreement before approval of the draft consent order. Oliver’s solicitor clients were completely successful in the negligence action. The QC was found to have breached his duty of care, but he won on causation. The claimant’s case failed.
