The husband brought all of the assets (c.£12.25m) into the marriage. The wife received a needs award of c.£4.05m. She incurred significant legal fees and owed c.£900,000 in respect of her litigation loan and outstanding costs. Francis J. awarded the wife only £400,000 in his needs calculation towards her litigation loan/outstanding costs on the basis that, even in a needs case, parties cannot litigate on the basis that they are bound to be reimbursed for their costs.
