Hayatleh v Mofdy (Presumption of Marriage) [2017] EWCA Civ 70

Date of Case: 14 February 2017
Case Reference: [2017] EWCA Civ 70

Whether a ceremony of marriage conducted in Syria could be held to be valid by the English court. The Court of Appeal upheld the decision of the judge at first instance, who had been satisfied that the husband (who challenged the validity) was unable to produce ‘clear, positive and compelling evidence’ to rebut the presumption of marriage established by the parties’ conduct over the years.
